Terms of Use

Unless otherwise indicated, the Tool and all content generated by the Tool—including but not limited to images, graphics, UI elements, branding, code, and text—are owned, controlled, or licensed by Thumbgen. The Content is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, distribute, or exploit the Content for any commercial purpose without Thumbgen's prior written consent.

Users must respect all intellectual property rights when using the Tool. Any unauthorized use of copyrighted materials—such as logos, artworks, or characters—is the sole responsibility of the User. Thumbgen is not liable for misuse of third-party content. Users agree to indemnify and hold Thumbgen harmless in case of any such legal claims.

All original content generated by the Tool on behalf of the User (referred to as "Projects") is owned by the User. However, Thumbgen retains a non-exclusive, royalty-free, worldwide license to use such Projects for marketing, research, or service improvement purposes.

If your Projects use third-party assets (e.g., stock fonts, images), you are responsible for securing proper usage rights. Thumbgen disclaims any liability for unauthorized usage of third-party materials.

By using the Tool, Users affirm they have legal capacity to enter into this Agreement and are not minors. They agree not to use automated systems to access the Tool or engage in any illegal or unauthorized activities.

Users agree not to:

• Reverse engineer, scrape, or interfere with the Tool
• Use the Tool for illegal or abusive purposes
• Attempt to circumvent security features
• Upload viruses or harmful files
• Misuse or harass Thumbgen staff or users

Any feedback or suggestions you provide may be used by Thumbgen freely and without obligation. All rights to feedback become the property of Thumbgen.

Thumbgen reserves the right to monitor usage, take legal action, and restrict access to the Tool at any time for violation of these Terms.

By using the Tool, you also agree to Thumbgen's Privacy Policy. The Tool is operated in India, and access from other jurisdictions is at your own risk.

All purchases are final. We do not offer refunds for subscriptions or credit top-ups. You are responsible for canceling subscriptions via your customer portal. Access remains until the end of your billing cycle.

10.1 Promotional Offers

Promotions are for new users only. Misuse (e.g., multiple accounts) will result in cancellation without refund. Thumbgen may change or end promotions at any time.

Thumbgen may terminate accounts for:

• Violating these Terms
• Illegal or fraudulent behavior
• Non-payment
• Any reason at Thumbgen's discretion

Upon termination, access ends immediately and any unused credits are forfeited.

Credit Reset: Monthly/yearly credits reset at the renewal date.

Rollover Option: At checkout, you may select to roll over unused credits. Requires an active subscription.

Yearly Subscriptions receive annual credits upfront based on Month 4 levels.

If canceled and reactivated, tier levels reset.

Thumbgen may change these Terms or update the Tool at any time. Continued use means acceptance of the updated Terms.

We do not guarantee the Tool will be available without errors or interruptions. Thumbgen is not liable for data loss or service downtime.

These Terms are governed by and construed in accordance with the laws of India.

Any disputes shall be resolved exclusively in the courts located in Hyderabad, Telangana, India, and each party consents to such jurisdiction.

The Tool is provided "as is" without warranties. We do not guarantee fitness for any particular purpose, or uninterrupted access.

Thumbgen shall not be liable for any indirect or consequential losses. You agree to indemnify Thumbgen for any claims resulting from your use of the Tool or breach of these Terms.

You are responsible for any data you upload or generate. Thumbgen is not liable for data loss or corruption.

You consent to electronic communications, records, and e-signatures for all agreements and actions related to the Tool.

Unless you explicitly opt-out, Thumbgen may use your generated content (thumbnails) for showcasing and marketing purposes.

Some partnerships involve sharing data with trusted third-party services. By using the Tool, you agree to such data handling where necessary.

These Terms form the complete agreement between you and Thumbgen. If any part is found invalid, the rest remains in effect.
